Terms of Service

1. Acceptance of Terms

By accessing or using OmpuTag's services, websites, NFC tags, or SMS features (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of the Service

OmpuTag provides a system that allows individuals who find lost items to contact the items' owners through a privacy-preserving communication flow. Communication may occur through web interfaces and SMS messages routed through proxy numbers. OmpuTag does not guarantee item recovery.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

4. User Responsibilities

You agree to:

  • Provide accurate and lawful information when registering a tag
  • Use the Service only for lawful, good-faith lost-and-found purposes
  • Take full responsibility for decisions and actions taken based on messages received through the Service

You are solely responsible for your interactions with other users.

5. Prohibited Uses

You may not use the Service to:

  • Harass, threaten, stalk, or intimidate others
  • Send spam, scams, or misleading messages
  • Impersonate another person or misrepresent ownership of an item
  • Transmit illegal, infringing, or abusive content
  • Attempt to interfere with, exploit, or abuse the Service or its infrastructure

OmpuTag may suspend or terminate access for violations at its sole discretion.

6. SMS Communications

  • By registering a tag, item owners consent to receive SMS messages related to their registered items.
  • Finders consent to receive SMS responses by initiating communication.
  • Message frequency varies
  • Message and data rates may apply
  • Reply STOP to opt out of SMS messages
  • Reply HELP for assistance

Opting out of SMS may prevent further communication and limit Service functionality.

7. Third-Party Services

OmpuTag relies on third-party providers (including SMS carriers and messaging platforms) to deliver parts of the Service. OmpuTag is not responsible for delays, failures, or errors caused by these providers.

8. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." OMPŪTAG MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee:

  • Successful item recovery
  • Message delivery or response
  • Continuous or uninterrupted service

9. Limitation of Liability

To the maximum extent permitted by law, OmpuTag shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of property, loss of data, or personal injury, arising from or related to use of the Service.

OmpuTag's total liability for any claim shall not exceed the amount you paid to OmpuTag in the twelve (12) months preceding the claim, or $50 if no amount was paid.

10. Indemnification

You agree to indemnify and hold harmless OmpuTag, its officers, members, and agents from any claims, damages, liabilities, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

OmpuTag may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. Continued use of the Service constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
